Circle Executive Committee Meeting at Ernakulam
On 13th June 2015
CEC of SNEA (I) Kerala Circle held at Ernakulam on 13th June 2015. Our beloved General Secretary Com. K. Sebastin attended and addressed the meeting. The meeting expressed its anxiety about undue delay in issuing Request and Long Standing Transfer Orders, delay in Reinstating the Data Service for Service Mobile Connections of Executives, Undue delay in implementing Corporate Office orders for settling the Agitation of SNEA (I) Kerala in 2014 and also for the delay in Restructuring of the Mobile Service as per the Restructuring Committee recommendations. The meeting has decided to Launch Organizational Programs for issuing and implementing these orders. The detailed report will upload soon.

Annual General Body meeting of Palakkad SSA
The Annual General Body meeting of SNEA(India), Palakkad SSA will be held on 26/05/2015 from 1pm onwards at Palakkad. Circle President Com K.Sudheer, Circle Secretary Com George Varghese, Area Secretary North Com MA Gafoor and Circle Organising Secretary Com G.Krishnakumar will attend the meeting. All members are requested to attend and make it a grand success.
Discussion with EPF Authorities at Trivandrum
The Association met EPF Authorities of Trivandrum EPF Office on 15.06.2015 and discussed the issues related to EPF. Asst. Circle Secretary Com. Aslesh S.S, CWC Member Com. Suresh Kumar. R and Circle Office Branch Secretary Com. Suneer represented the Association.
At the outset the Association have elaborated the present EPF system followed in BSNL and also the difficulties in transferring Inter circle and intra circle Provident Fund while on transfers even after UAN. The Association have also enquired the possibilities of UAN as an easiest way of handling the EPF transactions for the maximum benefit of Employees.
EPF authorities explained the details regarding EPF as follows. Presently Statutory Pension basic is Rs. 15000/- instead Rs. 6500/- since September 2014. And they have also verified that the 8.33% of Rs. 15000/- is being credited to the Pension Fund.
The Association asked whether any organization is having the Full Pension Option under EPF Pension Act and how it can be implemented in BSNL. EPFO replied that there were many companies having the option of Full pension option instead of Statutory Pension Basic of Rs. 15000/- at present. And also they have clarified that not the Employee but the Employer has to choose the Option for Pension at the time of EPF enrollment, and BSNL opted the Statutory Pension option of Rs. 6500/- which is revised as Rs. 15000/- at present. Once the Option is exercised, no further change is entertained by EPFO. Hence They have clarified that BSNL employees under EPF act. will be in statutory Pension Basic Option in the future too. So it is learnt that No batches are going to get the full pension option since BSNL is already opted statutory Pension as an employer. It can be only settled by the intervention of Highest Level of Central Ministry or by Legal Battle.
The Association have also sought the clarification of New account opened for all employees under EPF Scheme working in Different SSAs and Mobile Services, Civil/Electrical Wing when the payment settlement is merged to Circle Office after the implementation of ERP. EPFO clarified that Employees need to submit the Form-13 which is used to transfer the Provident Fund from Old Account to New Account and which can be done online in EPFO website. And also advised to submit the hard copy of the same after filling online form to the present employer to Merge the Old account to New Account, otherwise there will be Two accounts under One UAN for each employees.
Hence, all EPF Account Holders may verify their present EPF Account No. and please initiate the Fund Transfer Application online if there is any change in EPF No. prior to ERP. As per the information available now, all the employees working other than Circle Office is having separate EPF Account from October 2014.
Dear Comrades, to get a Financial Security at the time of Superannuation not only 30% Superannuation Benefit but also the Full Pension Benefit is required. We are also seeking Legal and High Level Interference to settle the Full Pension Option for every EPF Holders in BSNL.
1. Signification of Present Statutory Pension Scheme
a. Provident Fund Balance will be high
b. Recurring Monthly Pension will be very less compared to the Financial status at the retirement stage.
2. Signification of Full Pension Scheme
c. Provident Fund Balance will be Low.
d. Recurring Monthly Pension will be very high compared to the present pension system and Pension basic will be half the Basic at the time of superannuation.

Fixation of First TBP Orders in Electrical Wing
It was already reported that Fixation of First TBP for JTO(Electrical) is still pending and the PGM (F) assured us to do the necessary persuasion in that regard. As assured by PGM (F), Circle Office has issued orders to implement the fixation as per first TBP order of pending cases. We sincerly thank circle administration, especially PGM (F) for his timely actions. View Order
Meanwhile CS speaks to CE(Electrical) Sri. M. sudheendran and requested to process the Looking After arrangement in SDE Cadre by calling option and also requested to retain the officers who were ordered for transfer in the name of ERP Implementation. CE assured to consider the requests positively.

Com. James P.T, SDE CSC, Panambilly Nagar, Eranakulam expired. Body will be at CSI Immanuel Church, Broadway, Eranakulam from 8PM to 9PM today. Funeral will be at 3PM on 21/05/2015, tomorrow, at Melukavumattom Church.

Meeting with the Administration on 16th May 2015
The Association had a detailed discussion on following issues with the Circle management in the pre-appointed meeting granted on 16-5-2015 which has lasted for more than four hours. The meeting was attended by Sri. MSS RAO CGMT, Sri.Sathya Murthy, GM(HR) , DGM HR and AGM(HR) from Management side and Circle President Com. K. Sudheer,Circle Secretary Com. George Varghese, Circle Treasurer Com. Prem Kumar. G ,CWC member Com.Suresh Kumar and Org. Sec y. Com. Shiyas represented the Association. In the meeting we discussed the following points.
1. Transfer case of executives 2015 .
The Association pointed out that nearly 150 executives were transferred in 2013 and some more executives transferred prior to 2013 had requested for transfer back to their earlier SSAs and it is the practice of the circle to consider these cases during April, May. It was opined that the cutoff date as March 31st in not logical as the transfer orders were issued only in the end of April 2013. After a lot of discussions on objections on many account, CGMT has agreed to consider the cases without insisting march 31st cut off by allowing reasonable margin to the extent substitute can be made available. It was also clarified that executives from SSAs like Kannur and Malappuram need not be transferred on long stay basis as there are no requests to these stations. As far as EKM SSA is concerned since the executives having 10 year stay is less, the request to EKM can be considered if EKM Executives are willing to move out of Ernakulam. Hence desired officers can give an option for ALP/KTM/TCR/ etc to the Circle Office and it will be duly considered. CGMT also told to give the request with more than one Choice SSAs so that Executives can move to nearest SSAs if the request to desired SSA could not be considered.
We have requested to consider the left out cases of Last Year in PTA,KTM ,TCR etc in priority. CGMT has instructed to workout a plan together with Admin and Association so that the request can be considered with minimum disturbances. We also requested to consider the case of Executives in Electrical Wing who were ordered for transfer at the time of ERP Implementation.
All SSA secretaries are requested to give details of the request cases with date of joining in SSA immediately to process the case further.
2.Pending Time Bound promotion cases.
We have expressed our gratitude to the management for issuing the most of the promotion orders and requested to issue the pending orders .It was assured that all pending cases numbering more than 90 will be issued before 31st May 2015.
Pay fixation pending cases i.r.o E1-E2 and E2-E3 of Electrical wing was specifically discussed in the meeting and assured that it will be settled.
3.Regularisation of pending leave cases.
The Association pointed out that leave requests of many executives are pending in various SSAs for clarification from Circle office. It was told that most of the cases are medical leave wherein the genuineness was confirmed or re-verified by the administration by second medical opinion. CGMT has told that sanction of leave is to be done by the respective controlling officers by applying their discretion and advised us to meet the respective SSA heads. But we informed that the Association had already met the SSA heads and it was informed that they were waiting for instruction from Circle office. At this point CGMT has instructed the Association to give the SSA wise pending list so that the case can be taken with SSAs.
All SSA secretaries are requested to give the details of leave pending/dies non cases immediately and also to meet their SSA heads since many SSAs have settled these cases.
4. DATA FACILTY TO EXECUTIVES.
We have expressed our concern on the decision of the Management to withdraw the 3G/Data facility unilaterally which was available to the executives for more than 5 years. We also informed the Administration that, since there is no 3G facility at present, attending 3G and Data Complaints are not possible and it is affecting the marketing and operational performance . Hence we request the Management to restore the facility .
CGMT has informed that this case has came to his notice for the first time, only in this year and it was decided to get the approval from corporate office. We have pointed out the inconveniences and informed that we are not convinced about the intention behind such decisions. We have opined that approval from corporate office could have been obtained by retaining the service as has been done in case of STV 341 in TMs case. CGMT has told that at this stage since the matter is referred to the corporate office and some positive decision is expected shortly. It was suggested to pursue the case at our level also at corporate office.
5. JTO to SDE promotion cases in Hon. High court of Kerala.
We have pointed out that the reply in this case has not been filed so far and stay is extended for 3 months. CGMT has instructed the DGMHR to get the reply filed immediately so that the case can be taken up early.
6. EPF Account.
We have requested the Management to take necessary action for transfer of EPF amount from old account to the new account opened by the CSC on implementation of ERP. GM HR agreed to give instruction in this regard. All EPF Account Holders may verify their EPF Number from October 2014 and necessary actions may initiated online for transferring the Old Account to New Account if there is any change in the Account Number.
6. ERP IMPLEMENTATION.
We have pointed out the various difficulties being faced by the filed units on this account especially with respect to the merger of Mobile , Civil, Electrical with SSAs like HR issues and payment to vendors in addition to general issues like Electricity payment etc. We informed that after the implementation of ERP all executives have become DATA entry operators without any assistance while all office assistants are continuing in the SSA offices. We have requested to provide some clerical assistance to field executives in the changed scenario of ERP and CDR . It was told that this issue can be discussed with GM finance and also with corporate office to give some privileges to non executives under ERP.
We also requested to initiate SMSs to the concerned SDE/JTO on the event of Electricity Bill Payment Clearance from Central Settlement Cell as done in IMS Package era and also requested the Administration to give sufficient FTPs to the Field staff especially for PM, MM and FICO modules.
7.Land Line Provision and Maintenance.
We have pointed out that there are good responses for new connection and reconnection with the new night calling free offer. But the shortage of labour and material is causing difficulties in fulfilling the demands. We have pointed out that the labours were not satisfied with the wages and we are unable to get additional labour.
8. Data congestion and integrated OMCR.
The suggestions made by the Association have been handed over to GM Mobile services for necessary action. We informed GM (HR) that we are only against installing Surveillance Camera and making 100 positions in a small Hall without considering the Basic Amenities and good working Environment. We request the Management to resume the work of Integrated OMCR in consultation with real stake holders for Office Cubicle arrangement since a lot of amount is spent on this account for the work of the new OMC.
9. SHORTAGE OF Battery.
CGMT has informed that new tender is being floated and instructed to scrap all life expired and faulty batteries for maximum new procurements of Batteries through the tender.
10. Commissioning of DG
The association has pointed out the difficulty of commissioning of DG installed by electrical wing on account of certificate from Electrical inspectorate. THE CGMT has agreed to sort out this issue with Electrical wing.
11. LAYING OF PLB along with PROJECT WING.
CGMT has appreciated our suggestion and agreed to instruct SSAs to take necessary action in this case. All SSAs secretaries may discuss this issue with SSA heads.
The Association also met GM(Marketing) Sri. Venkataraman and discussed the Marketing issues and the positive trend in the Land Line since the launch of New Offer. We also met PGM (F) Sri. Kolanthavel and discussed about the issues of ERP and also informed him the importance of new procurements of stores like Battery, Cable etc for the upgradation of the Network and also to keep up the positive trends in the market. PGM (F) expressed his maximum co-operation in this regard. PGM (F) has also requested all to register the Dockets on various issues of ERP which can be further settled with the ERP Vendor at the earliest.

After detailed discussions with CMD, DIR HR, ED(Fin) and Sr GM(SR) on all the issues contained in the notice and concrete assurances given by Mangement that issues would be resolved by 15th August 2015, CHQ has decided to Call off the Trade Union actions.

CS writes CGMT Kerala to consider the transfer request of all officers who were transferred during 2013 irrespective of their date of completion along with other genuine cases.
It is also requested that the case of request transfer and long stay transfer may be considered simultaneously and to desist from any move for transfer of officers on long stay basis alone without considering the request transfers.

In spite of our repeated request to have a fruitful discussion on the transfer case in the circle as the practice followed hither through, it appears that the Circle Admin is going ahead with unilateral decision on transfers.

As per the reply received to the Association, the Circle Administration has once again reiterated that the Admin is not ready to honor the commitments made in the past to the executives. Further to our request to consider the case of all executives transferred during 2013, it is informed that only those cases which are completing 2 years as on 31-3-2015 will be considered while most of the cases are completing 2 year in April, May 2015.
The circle Admin.once again negated to recognize the legitimate expectation of an executives to get transfer to their home SSA while Corporate office is issuing transfer orders to all cadres right from SDE to CGM on completion of 2 years. (GM Finance Kerala Circle was transferred to Hyderabad on completion of 2 years recently). The present move of the Admin is nothing but demoralizing which will result the efficiency of service. The healthy HR policy that was prevailing in the past is likely to be further worsen in the coming days with the present attitude of the Circle Admin.
Members are requested to be alert and prepared, to mark our protest if things goes wrong.

Follow-up actions by Circle Office on SNEA's Letter dtd 03/03/2015 on review of the implementation of METALOLV & M0TIVE software for BB services.
As a follow-up action of our Letter Dated 03/03/2015, Circle Office has asked a detailed report from SSAs on the problems encountered due to the implementation of the above softwares and also to intimate whether these are implemented in each SSAs & are helpful for BB services in the maintenance point of view, compared to other software modules in use.

Protest Demonstrations at Circle Office and SSA HQs by Joint Forum!!!
Protest demonstration at All SSA HQs were conducted by Joint Forum in a grand manner. Members of All Unions/Association of the Joint Forum Viz. BSNLEU, NFTE, FNTO, SNEA (I), AIBSNLEA, BTEU BSNL, TEPU, AIGETOA and BSNLMS were participated. All the Leaders pointed out the deterioration of Service in All Sectors of BSNL, Kerala for the last two years. When Andhrapradesh, Tamilnadu etc. Circles are giving nearly One Lakh Landline connections , Kerala Circle is giving only 40000 NPCs during the financial year. MNP Port outs are started growing high mainly due to Network issues. First time in the history, Broadband connections are also showing downward trends.

Deterioration in Service in Kerala cirle - Protest and Save Kerala Circle!!!
The Circle level meeting of Forum of BSNL unions/Associations Kerala circle held at Trivandrum on 07.02.2015 discussed the developments on service as well as on staff
matters. It was generally agreed that the circle administration has not given due importance to the agreement and assurances reached during the discussion held on 29.12.2014. Though suggestions/modifications were given to the circle administration twice the revised minutes has not been issued so far. On the contrary SSAs are going ahead with conversion of the mobile connections of TMs in to CUG 200 by withdrawing STV 341.The Service connections at residence of Executives are also not restored as agreed in the meeting. More over some other burning issues have developed during this period. Complete outsourcing of the existing call centre work without any communication even to the unions or staff, IN migration, announcement of Black out day, Implementation of ERP etc have created new problems to staff and the general public.
It is also observed that NITs have been floated by the Electrical and Civil wing in Kerala Circle for the civil and electrical works in OMCR room at Telephone Exchange PanampillyNager with estimated costs of nearly 1.5 crores. The work involves electrical/LAN wiring and installation of surveillance cameras for live transmission and recording at new OMCR room Panampilly Nagar, to be extended to CGMT’s office. Civil works involve arranging 100 positions. When BSNL is under utter financial strain, spending lakhs of rupees for such activities on non productive nature is nothing but waste of money. The above work is only to centralize the NMS activities. Extending the live recording of movement of personal posted in the OMCR to CGMT office will not add any additional revenue. It may be noted that the above amount which is going to be spent for installing surveillance cameras can be utilized for purchasing 1000kms of 5 pr cable or 3000kms of drop wire at a time , when we are starving for these bare basic requirements.
Another moot question that props up in this connection is the surveillance of personnel, most of them ladies, even at odd hours of the night, is an infringement on their privacy. We, therefore, request the circle management to desist from installation of surveillance cameras and for the proposal for centralising the NMS activities at forbidding costs and to deploy the scarce resource for better productive purposes and thereby to create an atmosphere of mutual trust and better output.
Orders issued on 5th Jan 2015 was totally against the instruction from corporate office. This clearly shows the anti union attitude of the circle administration towards a democratically and peacefully held Dharna for saving BSNL . As per the order dt 5th Jan 2015 the leave applied for by the officials were not granted. It is quite clear that the circle administration issued with a clear intention to curtail the trade union rights of the workers and no other circle had issued such an order. The forum requests the administration to withdraw this order dt 5th January 2015.
It was informed during the discussion on 29th December 2014 that merger of the mobile wing with SSAs was done as per the corporate office instruction. But it is understood that corporate office has issued clear instructions vide No.MOB.-14/NWO-CM-III/QoS/2014-15 dated 2-12-2014 that BSS System like BTS/ node B and Associated items, BSC/RNC and associated items and multilink shall be the asset of CM verticals in the Circle and maintenance activates of these items shall be the responsibility of BSS team directly under CM vertical with man power and resources under it. It is, therefore, once again requested to implement the organizational structure in ERP for CM vertical in Kerala Circle strictly as per the guidelines issued by the Corporate Office.
Immediate action is requested on the following issues
1. Stop Outsourcing of Call Centres. Allow departmental call centres to function for land line, BroadBand, Mobile effectively diverting calls to departmental Call Centres.
2. Issue Revised minutes taking into account the true spirit and content of the
discussion held on 29-12-2014.
3. Immediate steps to arrest mass scale disconnection of mobile, land line, and Broadband Connections. Take urgent measures to improve in the area of MNP favouring inward porting.
4. Procure and supply adequate equipments and store materials.
5. Increase 2G and 3G and Wimax Coverage of all over Kerala
6. Improve the service of Mobile as well as broad band and landline sector.
7. Address the problems being faced by the Customers and public after the IN migration.
8. Settlement of Problems related on implementation of ERP
9. Ensure timely payment of GPF, Medical Claims, Contract labour wages , payment of infra structure workers etc.Amount recovered towards Society, Bank, LIC, other financial institutions be paid in time to avoid payment of penal interest
10. Implement the order regarding Merger of Mobile on ERP
11. Honour the commitment given to the unions on Civil/Electrical Merger.
12. Supply of adequate number of SIM Cards,Recharge coupon etc to CSCs
13. Desist from the move to install and extend surveillance Camera at OMCR
Ernakulam to CGMT Trivandrum
14. Urgent Steps to avoid massive Cable Damage and realization of damage cost from
the agencies concerned.

JTO to SDE promotion stayed – Most unfortunate.
Dear comrades,
SNEA(I) from CHQ to SSA level was taking all possible steps administratively and legally for the promotion from JTO To SDE for the last more than 2 years to settle the case at the earliest.
Initially the bottleneck was form CAT Chennai. SNEA(I) have intervened in the case by engaging best lawyer , spending huge money. We could succeed in the case. But unfortunately the 'same elements' played their role at Ernakulam CAT and stayed the DPC. Again by struggling for more than one and half year and by engaging the eminent Senior lawyer Sri. O V Radhakrishnan, we could defeat the design for stopping the DPC. All the prayer of the applicant were dismissed by the Hon. Court.
But they approached Hon. High Court on appeal and now the promotion is stayed for 3 weeks . SNEA(I) is taking all possible steps to remove the stale mate in the court.
At the same time sending VC and ACR were a herculean task . All the office bearers from CHQ to SSA level were involved in the process on a day to day basis even on individual cases.
Now to our understanding, the VCs send from Kerala circle will expire by 19th Feb 2015 and hence fresh VCs are to be send so that the promotion orders can be issued when the court lift the Stay. All are requested to be vigilant and involved in sending the VCs from their unit without fail.
Some Associations are reporting through their website regarding their “untiring consistent effort!!!”
The fact is that their effort is only reporting in the website. Other than SNEA no other associations had never took any role in this case. Though one Association impleaded in the case they NEVER FILED any reply or appeared in the case while another Association promoted the applicants behind the curtain to stay the DPC.
It is understood that some vested interests are making misleading arguments just to block the entire promotions of their colleagues who are waiting since 1994 for more than 20 years. We request everyone to realize that Today's’ Juniors are tomorrows seniors, perhaps it may take some more years for them to understand the agony of waiting for a promotion for long years.
During the hearing on 4-2-2015 before Hon. High court the Senior Advocate Sri O V Radhakrishnan has appeared for SNEA and Circle secretary has briefed the lawyers on 3rd and 4th and is taking further steps required in the case.
SNEA(I) is for open a smooth path for promotion to all officers and it will explore all avenues, both administratively and legally in getting the promotion orders issued at the earliest.
